737 MAX Certification Oversight

The Department of Transportation announced this week the formation of a new “special committee” of outside experts to look at the FAA’s process for certifying new airplanes. The panel will be led on an interim basis by former ALPA President Lee Moak and retired Air Force General Darren McDew.

Additionally, Transportation & Infrastructure Committee Chairman Peter DeFazio and Aviation Subcommittee Chairman Rick Larsen encouraged Boeing and FAA employees to utilize whistleblower protocols if they have any information relevant to the Committee’s investigation of the FAA’s approach to certifying the Boeing 737 MAX. They also formally requested that the DOT launch an investigation into the aircraft certification process.

Independent Medical Exam (IME)

Independent Medical Exam (IME) or Qualified Medical Evaluation (QME)  IME/QME may be requested by Sedgwick.  The results of the IME are legally binding. This means that if the IME clears you to return to work, your Work Comp benefits will cease immediately. If you disagree with the results of the IME/QME based on your own and your primary treating physician’s assessment, there is an appeals process in each state. Contact your state’s Workers’ Compensation office to find out if you are required to attend the IME/QME or for information about filing an appeal.

Scheduling Systems Mis-award

Report any suspected mis-awards to FABRC immediately upon discovery. This documents the issue with the Company and adds a time stamp to your claim. After speaking with a FABRC representative, fill out a Scheduling Systems Issues Report. This report logs your issue with APFA where we complete our own research. It is also documented and tagged for contractual violations. If the suspected mis-award is with TTS or UBL transaction, submit the issue via the TTS Support Link immediately and follow up with a Scheduling Systems Issue Report.

Reserve to Lineholder

Last September, the Company put out a communication explaining how Reserves to Lineholders are processed. In this communication it explained a Reserve wishing to bid in ROTA/D to fly into a line month on days off will need to check the “Award into FD/GD” box to be considered. We do not agree that Lineholder days off should be considered Flex Days, as the program is currently reading it. We have been in discussions with the Company regarding this programming and hope to have it revised soon. In the meantime, keep in mind as we approach the transition from one month to the next, ROTA/D programming considers Lineholder days off as Flex Days. A Reserve cannot be awarded into these days unless the “Award into FD/GD“ box is checked, however the Company may assign you into these days.
