1114 Bankruptcy Court Update 8.8.12
On August 8, the Bankruptcy Court approved a scheduling stipulation between American Airlines and the Retiree Committee for the suit that American Airlines filed on July 6, 2012. In that lawsuit, American Airlines asks the Bankruptcy Court to declare that it has the unilateral right to modify retiree health and life benefits.
1. American will file a motion by August 15 that will argue that the Court can decide this issue as a matter of law with   no trial.Â
2. The Retiree Committee will have until October 22 to take discovery on this issue and file a response.Â
3. American will be given an opportunity to reply to that filing by November 12Â
4. Retiree Committee will have until November 27 to file a sur-reply.Â

The Court will set a hearing for argument on this matter for sometime in December. There is no set ruling date. The Retiree Committee believes that American Airlines’ position is not well-founded and it will continue to vigorously oppose the relief American Airlines seeks.
